Are you absolutely sure there is no scrollbar on the iPad TOC? Scrollbars in iPad apps are very tiny compared to Windows equivalents. So I'm just wondering if perhaps you may have missed the tiny little iPad indicator that shows how long (in relative terms) the TOC is. On my iPad the scroll indicator is only present while you are scrolling, and disappears after a few seconds when you take your finger off the screen. It's very easy to miss.
